1. USCIS announced that for all employment-based preference categories, you must use the Final Action Dates chart to determine whether you can file I-485 in July 2020.
2. Your I-485 cannot be approved until your priority date (PD) is current under the Final Action Dates chart.
3. You are entitled to the PD of your first-approved I-140. If you were born in India or China and are now thinking about filing an EB1A case, you may consider filing an NIW petition as soon as possible to secure an earlier PD.
The citation requirement of EB1A is much higher than that was before. Currently, it's a good idea to secure a PD by filing an NIW first. You will be able to port the NIW PD to your later-approved EB-1 case, if the visa bulletin of EB1 is faster than that of NIW.
Please feel free to contact us for a free evaluation for your EB1 and/NIW case.
